These Terms & Conditions (“Terms”) govern your use of the Bathroomfort website (“the Site”) and any purchase you make from us. By browsing the Site or placing an order you agree to be bound by these Terms. Please read them carefully before you buy.

1. About us

Bathroomfort is an online retailer of bathroom suites, vanities, showers, taps, tiles and related accessories serving customers across the United Kingdom. If you need to get in touch about an order or any of these Terms, please see our Contact page.

2. Placing an order

When you place an order through the Site you are making an offer to buy the products in your basket at the prices shown, subject to these Terms. A legally binding contract is formed only when we send you an order confirmation email. We reserve the right to decline any order, including where:

• the product is out of stock;
• there was an error in the price, description or image of the product;
• we are unable to obtain authorisation for your payment;
• we suspect the order is fraudulent; or
• we cannot deliver to the address you provided.

If we cannot accept your order, we will let you know by email and refund any payment you have already made.

3. Prices and payment

All prices displayed on the Site are in pounds sterling (GBP) and include UK VAT at the applicable rate. Prices may change at any time, but price changes will not affect orders we have already confirmed.

Payment is taken at the point of checkout through our secure payment provider. We accept major debit and credit cards as well as other payment methods displayed at checkout. Your card is charged at the time the order is placed.

4. Delivery

We deliver to addresses in mainland England, Wales, Scotland and Northern Ireland. Delivery timescales and options are shown at checkout and in our Delivery Details page. Delivery timescales are estimates; we will do our best to meet them but cannot guarantee a specific delivery day unless you select a named-day option.

Risk in the products passes to you when the goods are delivered to the address you supplied. You become the legal owner of the goods once we have received payment in full.

5. Cancellations and returns

In addition to your rights under the Consumer Contracts Regulations 2013, you may cancel your order and return goods for any reason within 365 days of delivery, provided the goods are unused, undamaged and in their original packaging. Please contact us before returning any items so we can issue you with a returns reference.

Refunds will be made to your original payment method within 14 days of us receiving the returned goods. You are responsible for the cost of returning non-faulty items unless we agree otherwise.

Custom-made, special-order or hygiene items (for example sealed toilet seats once the seal is broken) cannot be returned unless faulty.

6. Faulty or damaged goods

If the products you receive are faulty, damaged in transit or not as described, please let us know within a reasonable time of discovering the issue. Under the Consumer Rights Act 2015 you may be entitled to a repair, replacement or refund. Please keep the original packaging where possible and contact us for return instructions.

7. Product information

We take care to describe and illustrate the products on the Site as accurately as we can. Product photographs are for illustration only; slight variations in colour, finish and dimension may occur. Dimensions and technical data are given in good faith but you should check critical measurements against the manufacturer’s specification before installing.

8. Availability

Product availability on the Site reflects our stock position at the time the page is viewed. In the rare case that an item becomes unavailable after you place an order, we will contact you with the expected timescale or offer a refund.

9. Use of the Site

You agree that you will not:

• use the Site for any unlawful purpose;
• attempt to gain unauthorised access to any part of the Site or related systems;
• introduce malware, viruses or any other technically harmful material;
• scrape, copy or republish Site content except as permitted by law; or
• place fraudulent orders or make false representations about your identity.

10. Intellectual property

All content on the Site — including text, images, logos, graphics, page layout and software — is owned by Bathroomfort or its licensors and is protected by UK and international copyright, trade mark and database-right laws. You may view and print pages for personal, non-commercial use only.

11. Our liability

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for any other liability which cannot be excluded or limited under English law.

Subject to the above, our total liability to you in relation to any order will not exceed the price you paid for the products. We are not liable for any loss of profit, loss of business, loss of revenue, loss of anticipated savings, or any indirect or consequential loss.

12. Your consumer rights

These Terms do not affect your statutory rights as a consumer. If you are a consumer buying as an individual rather than in the course of a business, you have legal rights in relation to products that are faulty or not as described. Advice about your legal rights is available from your local Citizens Advice Bureau or Trading Standards office.

13. Privacy

Your use of the Site is also governed by our Privacy Policy, which explains how we collect and use your personal data.

14. Changes to these Terms

We may update these Terms from time to time. The version in effect at the time you place your order will apply to that order. We will show the date these Terms were last updated at the top of this page.

15. Governing law and jurisdiction

These Terms, and any dispute or claim arising out of or in connection with them, are governed by the laws of England and Wales. Any dispute will be subject to the non-exclusive jurisdiction of the courts of England and Wales.
